Rules and Regulations
Regulations that determine how people hunt, trap or fish for wildlife in Utah are contained in both state statutes (code) and division administrative rules. State statutes are passed by the state legislature; the administrative rules are passed by the Wildlife Board. The Utah Division of Wildlife Resources (DWR) and the Regional Advisory Councils (RACs) makes recommendations about rules to the Wildlife Board. The DWR implements and enforces these statutes and rules.
Wildlife administrative rules are regularly reviewed and modified by the Wildlife Board to meet changing wildlife needs.
Utah State statutes: Each year, the state legislature creates or modifies statutes that affect wildlife. Most statutes affecting wildlife are contained in Title 23A, but other statutes may also affect hunting and fishing.
Hunting and fishing guidebooks: The DWR publishes various hunting and fishing guidebooks (proclamations) to provide people with the information needed to legally engage in wildlife-related activities in Utah. These publications contain a mix of information from both Utah’s statutes and the Board’s administrative rules. These guidebooks also contain other helpful information to assist hunters, anglers, and trappers.
Trespass Laws For Hunters & Anglers
1. Written permission is required to enter or cross properly posted private property.
2. Written permission is also required to access unposted private property if:
The soil has been loosened or broken up for the raising of crops
There are crops on the land
The land is a pasture irrigated by a sprinkling system or ditches
3. In addition, those taking wildlife while trespassing may be charged with an additional Class B Misdemeanor for illegally taking wildlife. The harvested wildlife is also subject to seizure.
