H.B. 94 Weapons Restrictions Amendments

Section Affected:
U.C.A. 76-10-523. Persons exempt from weapons laws.
U.C.A. 76-10-528. Carrying a dangerous weapon while under influence of alcohol or drugs unlawful.

Under this Bill it would change the wording of 76-10-528 and make it LEGAL for a person who is under the influence of alcohol or drugs to:
• Carry a dangerous weapon that is either securely encased or not readily accessible for immediate use
• Use or threaten to use force in compliance with Section 76-2-402
• Carry a dangerous weapon in their home, their business or someone else’s home with the consent of the owner.

This Bill does not allow an individual to carry a firearm while under the influence. It allows an individual who is under the influence to defend themselves if necessary.

While we do not support carrying a firearm under the influence, due to an individuals judgment and mental process being affected, we DO support an individuals right to be able to protect themselves even if they have been drinking, especially since Utah law changed at the end of December 2018 and the BAC was lowered from .08 to .05.
